Terms and Conditions

(1) General

We agree to provide the following online physiotherapy, online fitness online diet chart services; including any assessment, diagnosis, advice or treatment program, manual hands-on treatment, follow-up appointments and ergonomic assessments to you in return for a fee subject to the terms set out in these Terms and Conditions of Service which forms the agreement between ‘you’ and ‘us’. These Terms and Conditions of Service includes the entire understanding between you and us and replaces any previous agreements we may have had with you unless specifically stated otherwise. Except for those terms implied by law, which cannot be excluded and any other terms specifically incorporated by reference – no other terms apply. These Terms and Conditions of Service are for our online physiotherapy services, online fitness and online diet chart. Please do not use our services if you do not agree to these Terms and Conditions of Service. You indicate that you consent to these Terms and Conditions of Service in full by purchasing any online Physiotherapy, online fitness and online diet chart Service from the Website. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS OF SERVICE YOU SHOULD NOT PURCHASE OUR SERVICES. Please note that We alter these Terms and Conditions of Service from time to time, and you must review this document before each purchase. This document was last changed on 25 NOVEMBER 2025.

(2) Consent

You signify your consent to these Terms of Service by purchasing any online physiotherapy, online fitness and online diet chart service from the website, in addition to the consent box we ask you to before booking appointment.

(3) Clients under 18 years of age.

We require written or verbal consent from your parent or legal guardian if you are younger than 18 years of age, who must also agree to be bound by these Terms & Conditions of Service Agreement. They must further provide proper supervision in relation to the provision of information to Us and provide proper supervision in relation to your use of our online physiotherapy, online fitness and online diet chart service. All written communication with patients under the age of 18 will be via their parent or guardian’s email address.

(4) Purpose and nature of the Safal Fitpro Online Services

You acknowledge that – (i) no online service is a perfect substitute for an “in-person” appointments with a physiotherapist, fitness instructor, dietitian or nutritionist. (ii) and as with “in-person” appointments, We are unable to guarantee that our treatments will result in a cure of your particular complaint or condition. We recommend treatments and exercise that We believe are likely (based upon our experience and training) to be effective, but We cannot guarantee results. (iii) Safal Fitpro / safal physiotherapy and weight loss center and its doctor, Trainer or staff shall not be liable for any injury sustained as a result of advice given. This is in reference to the above comments regarding online service not being a perfect substitute for “in-person” assessment. (iiii) WARRANTY OF PHYSICAL FITNESS: By purchasing and participating in any of our services or programs, the Client warrants, represents, and affirms that they are in good physical health and medically cleared by a licensed physician to participate in strenuous physical activity. The Client understands and agrees that participation is entirely voluntary and assumes full responsibility for any and all risks, injuries, or damages that may occur from participation, whether known or unknown.

(4A) DISCLAIMER: NOT MEDICAL ADVICE

The services provided by Safal Fitpro / safal physiotherapy and weight loss center (including physiotherapy, fitness, and diet chart advice) are for educational and informational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment from a licensed physician or primary healthcare provider. You should always seek the advice of a qualified healthcare professional with any questions you may have regarding a medical condition. Do not disregard professional medical advice or delay in seeking it because of something you have read or received through our Services.

(5) Suitability and Termination of Our Services

We reserve the right to terminate these Terms and Conditions of Service and cease providing service to you immediately at any time for any reason, including but not limited to:

Where We have evaluated/assessed your condition and We believe that We are unable to provide an acceptable treatment, fitness, or diet program online.
Your breach or non-compliance of any of the terms associated with the Safal Fitpro/safal physiotherapy and weight loss center Services, including but not limited to:
- Failure to meet Specifications: Non-compliance with the Specifications set out in Section (15) (e.g., technical requirements, required applications, or camera setup).
- Misuse of Service or Content: Any violation of Section (12) (Intellectual Property and Permitted Use), such as unauthorized sharing, copying, or distribution of our materials, which will result in immediate termination.
- Failure to provide accurate and complete information as required in Section (6).

Where we terminate the service for reasons other than your breach, we will offer a full or partial refund of the fee paid for the remaining services, determined at our sole discretion. No refund will be provided in the event that your service is terminated due to your breach or non-compliance of any of Our terms, including but not limited to your failure to meet the Specifications in Section (15).

(6) Provision of information by you

The quality and success of the online physiotherapy, online fitness, online diet chart services is reliant upon the information that you provide to Us. In this regard, you agree to provide Us with: (i) accurate and complete information in response to our online questionnaires and any follow up questions which We may ask of you either in writing or via a video conversation on the Internet; and (ii) any information which could reasonably be expected to be relevant to your condition or treatment.

(7) STRICT LIMITATION OF LIABILITY:

Safal Fitpro / safal physiotherapy and weight loss center, its trainers (including Deepika and Anjali), contractors, and affiliates shall NOT be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to, damages for personal injury, illness, or death, whether such liability is asserted on the basis of contract, tort, or otherwise, even if caused by the negligence of Safal Fitpro / safal physiotherapy and weight loss center. The Client and Patient understands that they are exercising and diet AT THEIR OWN RISK and agrees to release, hold harmless, and indemnify Safal Fitpro / safal physiotherapy and weight loss center from any and all claims.

(8) Using Our Online Physiotherapy Services

Full understanding required: You must not implement our treatment program or act on any advice unless you fully understand it.
Please ask any questions before implementing any treatment program or acting on any advice provided by Us.
Cessation: The phrase ‘No pain, no gain’ does not apply to any treatment program or advice provided by Us. You must immediately cease using our treatment program and cease acting upon any advice given by Us if you experience any pain or discomfort. In these circumstances, you must contact Us as soon as possible.
Third persons: You must not provide our treatment program to any other person. We assume no duty of care in relation to any third persons.

(9) Private Medical Insurance and Claims

Please be advised that Safal Fitpro / safal physiotherapy and weight loss center operates strictly on a self-pay basis.

No Direct Billing: We do not collaborate with, nor are we registered providers for, any private medical insurance companies, either in India or internationally.
No Claims Support: We are unable to directly bill insurance companies, provide pre-authorizations, or handle any insurance claim submissions on your behalf.
Payment Responsibility: You are required to pay the full fee for all services at the time of booking or as agreed upon.
If you wish to seek reimbursement from your insurance provider, we can furnish you with a detailed electronic invoice (receipt) in soft copy (PDF) upon request, sent directly to your email address. It will be your sole responsibility to submit this invoice to your insurance company for any potential claim or reimbursement.

By booking and paying for our services, you acknowledge and agree that you are ultimately responsible for the full cost of your treatment.

(10) Cancellation, Rescheduling, and General Non-Refund Policy

We value the dedicated time and specialized effort invested by our professionals in preparing and delivering your confirmed service (whether it is a personalized video, physiotherapy session, or dietary consultation). We require your commitment to the service delivery schedule once it is finalized.

Due to the specialized, personalized nature of our service creation, scheduling, and preparation, all confirmed bookings and purchases are final and non-refundable by the Client or Patient. We cannot accommodate client-initiated cancellations, rescheduling requests, or exchanges once an order or appointment has been booked and confirmed. We encourage you to ensure your availability and specifications are correct before confirming your order or session.

This policy is strictly enforced, subject only to the provisions of our Refunds Policy in Section (11) and our right to terminate service under Section (5).

In the rare event that we must cancel or significantly delay the delivery of your confirmed service due to an unavoidable and unforeseen circumstance on our end, we are fully committed to ensuring you receive the value you paid for. We will proactively reach out to you to reschedule your appointment or redeliver your video/plan at the earliest time convenient within our schedule.

(11) Refunds Policy

"We are committed to ensuring our service is the right fit. If we conclude that our service is not suitable for your needs, or for other reasons at our sole discretion, we reserve the right to offer a full or partial refund."

Processing Details Method of Refund: Any approved full or partial refund will be processed back to the original payment method used for the transaction. Timeline: Once we initiate the refund, we will notify you via email. The time it takes for the funds to be credited back to your account is dependent on the processing speed of the respective payment gateway (e.g., Razorpay, Stripe, etc.) and your bank. Typical Waiting Period: This process typically takes 5 to 10 business days from the date the refund is initiated by us.

(12) Intellectual Property and Permitted Use

All videos, PDF files, documents, and other materials provided to you as part of the “Service” are the exclusive property of Safal FitPro and are protected by copyright laws. You are granted a non-transferable, limited license to use these materials solely for your personal and non-commercial purposes. Strictly Prohibited Actions: You must not copy, reproduce, distribute, upload, or electronically share any of this content, in whole or in part, with any third party, whether through Google Drive, email, social media, or any other means, without the express written permission of Safal Fitpro / safal physiotherapy and weight loss center. Any unauthorized sharing or misuse constitutes a violation of these Terms and may result in the immediate termination of your service and/or legal action.

(13) Use of the online physiotherapy, online fitness online diet chart services outside of the INDIA

We make no claims or representations that the online physiotherapy, online fitness online diet chart services may be lawfully used outside the India. Unless otherwise expressly stated or agreed, the online physiotherapy, online fitness online diet chart services are directed solely at patients who receive the Safal Fitpro / safal physiotherapy and weight loss center from within the India. If you choose to access or use the Safal Fitpro / safal physiotherapy and weight loss center from outside of India, you do so at your own risk, and are subject to the judiciary system India.

(14) Governing law

"These Terms of Service and all documents incorporated herein are governed by and construed in accordance with the Laws of India. You agree to submit to the exclusive jurisdiction of the Courts in Rajnandgaon, Chhattisgarh."

(15) Specifications for Safal Fitpro / safal physiotherapy and weight loss center services (what you will need)

You agree to have the following in place to enable us to provide you with Our Online Services (Physiotherapy, Fitness, and Diet Chart):

(i) good working Internet connection;

(ii) necessary microphone / headphones / camera or similar equipment;

(iii) Zoom, Skype or WhatsApp application unless We have agreed with you to use a different application or platform.

(iiii) A Stable and Fixed Camera Position that allows the therapist/trainer to clearly view your full body and range of motion. This requires your phone, tablet, or laptop to be positioned securely, enabling you to be completely hands-free during the session.

(iv) We do not accept any liability in the event that you are unable to comply with the Specifications set out above.

(16) Confidentiality of Client Information

Anything clients share with a physiotherapist, trainer, or staff is regarded confidential, whether it is business or personal information. The physiotherapists, trainers, and staff undertake not to, at any time, (unless required to do so by law), either directly or indirectly, use or disclose any information the client shares with them during their sessions.

(17) Client Data Privacy and Consent

You acknowledge and agree that in order to provide the Service, we must collect, store, and process personal and sensitive information about you, including:

Your contact information (name, email, phone number).
Your health and medical data (information provided in questionnaires, video assessments, and consultation notes).

By purchasing our Services, you consent to Safal Fitpro/safal physiotherapy and weight loss center and its staff collecting, storing, and utilizing this data solely for the purpose of:

Providing, managing, and improving your online physiotherapy, fitness, or diet chart services.
Administrative and billing purposes.
Complying with legal or regulatory requirements.

Security and Storage: We will take reasonable steps to ensure your personal data is handled securely and in accordance with applicable data protection laws in India. We do not sell or rent your personal information to third parties. Your Responsibilities: You are responsible for ensuring the accuracy of the information you provide. (18) Definitions

In this document and the documents and videos incorporated by reference, the following terms have the following meanings unless the context clearly requires otherwise:

“Breach” or “Breach of Terms” means any failure by you (the Client or Patient) to comply with, observe, or perform any term, condition, representation, or obligation set out in these Terms and Conditions of Service. Examples of a Breach include, but are not limited to, unauthorized sharing of our materials (Section 12), failure to provide accurate information (Section 6), or non-compliance with technical Specifications (Section 15).
“Client” means a person purchasing or receiving online fitness or online diet chart services from us.
“Patient” means a person purchasing or receiving online physiotherapy services from us.
“Service” means the terms and conditions of purchasing our online physiotherapy, online fitness, online diet chart services as set out in this document and the documents and videos incorporated by reference;
“Website” means the web site located at the domain “www.safalfitpro.com” and on all sub-domains, folders and sub-folders on this domain.

(19) Interpretation

In this document, unless the context clearly requires otherwise: The terms “we”, “us” and “our” are references to are provided via this web site, which is owned and operated by safal physiotherapy and weight loss center. Words defined in the singular have the corresponding meaning in the plural; Reference to a “person” includes a reference to a corporation, association or other entity; Reference to the “Parties” means both you (the Client or Patient) and us. Reference to “Client” or “Patient” includes the person receiving any of the services offered by us.
